This Privacy Policy describes how we collect, use, disclose, and protect personal information when you visit our website at www.wandah.co, purchase our products, create an account, contact customer support, or otherwise interact with our website, products, communications, and related services (collectively, the “Services”).

This Privacy Policy is incorporated by reference into our Terms of Service. In the event of a conflict between our Terms of Service and this Privacy Policy with respect to the collection, use, or disclosure of personal information, this Privacy Policy will control.

  • Customer records and payment-related information, including billing address, shipping address, order history, payment confirmation, and information needed to process a transaction. Payment card data is processed by our payment processor and is not stored by Hope Innovations 
  • Account information, including username, password, account preferences, saved cart, and related account settings 
  • Commercial information, including products viewed, added to cart or wishlist, purchased, returned, exchanged, or considered 
  • Communications, including information you provide when you contact customer support, submit a replacement claim, respond to a survey, or communicate with us by email, phone, or other means 
  • Device and internet or network activity information, including IP address, browser type, operating system, device identifiers, pages visited, links clicked, time spent on pages, referring URLs, and interactions with the Services 
  • General location information, including approximate location derived from your IP address. We do not collect precise GPS location unless we first obtain your express consent 
  • Inferences, such as preferences or interests that may be derived from your activity on the Services 
  • Consumer Health Data and other sensitive personal information that you voluntarily provide, including information about a health condition, medical history, medications, symptoms, product experiences, or product use that you choose to share with us 

We do not knowingly collect government identifiers, biometric information, precise geolocation, education information, or employment information unless you choose to provide that information to us or the collection is otherwise described at the time of collection.

We may collect personal information from:

  • Directly from you when you create an account, make a purchase, contact us, submit a replacement claim, provide feedback, or otherwise communicate with us 
  • Automatically through the Services, including cookies, pixels, analytics tools, and similar tracking technologies 
  • Shopify, payment processors, shipping carriers, customer support tools, email marketing platforms, analytics providers, advertising partners, and other service providers acting on our behalf 
  • Healthcare providers or other third parties who purchase products on your behalf, refer you to the Services, or provide information needed to fulfill an order 
  • Business partners or other third parties, as permitted by law and consistent with this Privacy Policy

How We Use Your Personal Information

We use your information to process and fulfill orders, process payments, ship products, create and manage accounts, process replacement claims, provide customer support, personalize your experience, and improve our products and Services.

  • Service providers and contractors, including Shopify, payment processors, shipping carriers, email marketing platforms, analytics providers, advertising technology providers, customer support tools, hosting providers, and other vendors that perform services on our behalf 
  • Healthcare providers, if a healthcare provider purchases a product on your behalf, refers you to the Services, or needs information to support order fulfillment or customer support 
  • Advertising and analytics partners, which may collect information through cookies, pixels, or similar technologies to help us measure traffic, understand use of the Services, and deliver or measure advertising 
  • Professional advisors, including attorneys, accountants, insurers, and other advisors

Summary

What we collect: We collect Consumer Health Data only when you voluntarily provide it, including in customer support communications, replacement claims, surveys, or other interactions in which you choose to share health-related information. We do not collect Consumer Health Data automatically or through tracking technologies.

How we use it: We use Consumer Health Data only to respond to your requests, process replacement claims, improve product safety and quality, and comply with applicable law. We do not use Consumer Health Data for advertising or marketing without your separate, express consent.

How we share it: We share Consumer Health Data only with service providers contractually required to use it solely on our behalf, as required by law, or with your express consent. We do not sell Consumer Health Data. We do not share Consumer Health Data with data brokers or advertising partners.

Sensitive personal information: We do not use or disclose sensitive personal information, including Consumer Health Data, for purposes beyond those described in this Privacy Policy and our Consumer Health Data Privacy Policy.

Relationship with Shopify

Our Site is hosted and our transactions are processed through Shopify Inc. (“Shopify”). Shopify processes personal information on our behalf as a service provider / data processor.

Shopify’s own privacy practices are described in Shopify’s Privacy Policy, available at https://www.shopify.com/legal/privacy. Hope Innovations remains responsible for the personal information processed by Shopify on our behalf.

Note: The categories of personal information processed by Shopify on our behalf include: name, email address, shipping and billing address, order history, and payment transaction data (processed but not stored by Hope Innovations). Shopify does not receive Consumer Health Data as defined in the Consumer Health Data Privacy Policy through standard order processing.

Third-Party Links

The Services may link to third-party websites, applications, or services. We are not responsible for their privacy practices or content. We encourage you to review the privacy policies of any third-party services you use.

Children’s Data

Our Services are not directed to children under the age of 18, and we do not knowingly collect personal information from children under 18 without verifiable parental consent. You must be at least 18 years of age to purchase our products. If we become aware that we have collected personal information from a child under 18 without verifiable parental consent, we will take steps to delete that information. We will respond to verifiable privacy requests within the timeframe required by applicable law. We may need to verify your identity by matching information you provide with information we maintain. We will use information provided for verification only to verify and respond to the request, unless otherwise permitted by law.

You may authorize another person to submit a request on your behalf where permitted by law. We may require proof that you authorized the agent to act for you, and we may require you to verify your identity directly with us.

You may opt out of promotional email communications at any time by clicking the “unsubscribe” link in any promotional email or by contacting hello@wandah.co. Even if you opt out of promotional communications, we may still send transactional or service-related communications about your orders, account, replacement claims, or other interactions with us.

We will not discriminate or retaliate against you for exercising your privacy rights. This means we will not deny goods or services, charge different prices or rates, provide a different level or quality of goods or services, or suggest that you may receive a different price, rate, level, or quality of goods or services because you exercised your rights, except as permitted by law.

California Privacy Notice

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, provides additional rights and requires specific disclosures. The categories of personal information we may collect are described above in “Personal Information We Collect or Process.”

California Rights

California residents may request to know, access, correct, delete, and obtain a portable copy of personal information, opt out of the sale or sharing of personal information, limit the use or disclosure of sensitive personal information where applicable, and exercise these rights without discrimination or retaliation. We use sensitive personal information only for purposes permitted by California law, including to provide requested products and Services, process transactions, maintain security, prevent fraud, respond to customer support requests, process replacements, and comply with law. We do not use sensitive personal information to infer characteristics about you except as necessary to provide the Services you request.

Notice at Collection and Retention

We collect the categories of personal information listed in this Privacy Policy for the purposes described above and retain them according to the retention criteria described in “Security, Breach Notification, and Retention.” We do not retain personal information longer than reasonably necessary for the disclosed purposes, unless a longer retention period is required or permitted by law.

Nevada Residents

If you are a Nevada resident, Nevada’s Consumer Health Data Privacy Law, effective March 31, 2024, may provide you with additional rights with respect to Consumer Health Data, as that term is defined under Nevada law. Nevada residents may request to confirm whether we collect, share, or sell Consumer Health Data, access Consumer Health Data, withdraw consent where consent is the basis for processing, request deletion of Consumer Health Data, and appeal a decision regarding a request, subject to applicable exceptions. Governing Law

This Privacy Policy and any dispute, claim, or controversy arising out of or relating to our collection, use, disclosure, or protection of your personal information are governed by the laws of the State of Iowa, without regard to its conflict-of-law principles.

Notwithstanding the foregoing, nothing in this Privacy Policy limits or waives any right or remedy you may have under the mandatory privacy laws of your state of residence, including but not limited to the California Consumer Privacy Act (as amended by the California Privacy Rights Act), the Washington My Health MY Data Act, Nevada's Consumer Health Data Privacy Law, or other applicable state privacy laws that cannot be waived or limited by contract. To the extent such laws apply to you, they govern with respect to the rights and remedies they provide.

Geographic Scope

Our Services are available only to residents of the United States. We do not accept orders from, or ship products to, addresses outside the United States. Our Site is not intended for use by individuals located outside the United States.
